Cohabitation disputes

More people are now choosing to live together rather than marry. Many cohabitees discover on the breakdown of a relationship that they do not enjoy the same financial rights and protection that a spouse enjoys on the breakdown of a marriage.

Settling cohabitation disputes

Financial issues, particularly those relating to property, are resolved through the Law of Trusts. In the event that there are children involved, there is provision under the Children Act 1989 for financial provision for a child to be made.

Another option is for cohabiting couples to enter into an agreement at the start of their relationship which could regulate proceedings in the event of a breakdown. A Cohabitation Agreement is a way that parties can protect their interests and assets, potentially saving legal costs in the future.
