Financial Remedies Guide 2026 provides new guidance to lawyers working on divorce cases
The Lead Judge of the Family Division and Deputy Lead Judge, Mr Justice Peel and His Honour Judge Hess, have released an updated 'Financial Remedies Guide' which sets out amended procedural guidance to family law practitioners.
The Guide is a useful conglomeration of various pieces of practice guidance that have developed over the years, and also provides some important updates to standard orders, the ES1 and ES2 (schedules of assets), and allocation.
Most importantly, cases worth between £15m-20m are now, by default, to be allocated to a district judge level, where previously they were to be allocated to a high court judge level.
The guide also repeats some guidance on the length of witness statements, which are capped to 15 pages including exhibits, and position statements, which are capped to 10 pages, 15 pages and 20 pages for the First Appointment, FDR and Final Hearing respectively.
